Serious car accidents are often caused by a failure to yield

Failing to yield the right of way is a cause of many serious accidents in Georgia. That type of negligent error is similar in many instances to making an improper left turn. Both violations involve causing car accidents by intruding into another vehicle's proper path of travel. A fatal accident that recently occurred in Burke County on Georgia Highway 25 involves that kind of driving infraction.

A vehicle driven by a 20-year-old male was traveling west on a local when it attempted to cross Highway 25. It traveled directly into the path of a pickup truck driven by a 64-year-old male that was heading south on Highway 25, according to the authorities. A 25-year-old man who was a passenger in the younger man's car was killed in the tragic collision.

The decedent was declared dead at the scene. The two drivers were taken to Augusta University Medical Center with serious injuries. The driver of the truck was in critical condition. Both the decedent passenger and the truck driver have viable claims against the driver who crossed into the truck's right of way. It is negligence to cross a highway or attempt a left turn when oncoming traffic is approaching.

A careful driver in that situation must slow down and approach the turn or highway crossing with extreme caution. The deceased passenger's family may file an estate on his behalf and make a claim for wrongful death damages under Georgia law against the driver of the car he occupied. The injured truck driver or his family may pursue the claim on his behalf.
